Regulation Guide

Understanding forex broker regulation and how to verify a broker's regulatory status.

Why Regulation Matters

Regulation is one of the most important factors when choosing a forex broker. A regulated broker is required to follow strict rules that protect traders, including:

  • Segregated Accounts: Client funds must be kept separate from the broker's operational funds.
  • Financial Reporting: Regular reporting to the regulator ensures transparency.
  • Investor Protection: Many regulators provide compensation schemes if a broker goes bankrupt.
  • Fair Trading: Regulated brokers must follow fair pricing and execution practices.
  • Dispute Resolution: Access to an ombudsman or arbitration process.

Major Forex Regulators

FCA (UK)

Financial Conduct Authority

One of the most respected regulators. Offers strong investor protection with the Financial Services Compensation Scheme (FSCS) covering up to £85,000.

ASIC (Australia)

Australian Securities and Investments Commission

Known for strict oversight and client fund protection. Requires brokers to hold a valid AFS license.

Verify ASIC license →

CySEC (Cyprus)

Cyprus Securities and Exchange Commission

Popular regulator for European brokers. Offers investor compensation up to €20,000 and is regulated under MiFID II.

Verify CySEC license →

CFTC/NFA (USA)

Commodity Futures Trading Commission & National Futures Association

US-based regulators with strictest rules. Required for brokers accepting US clients. Offers strong investor protection.

Verify NFA membership →

FSA (Seychelles)

Financial Services Authority (Seychelles)

Offshore regulator with lighter requirements. Often used by international brokers. Less investor protection than tier-1 regulators.

FSC (Mauritius)

Financial Services Commission (Mauritius)

Popular offshore regulator for international brokers. Moderate regulatory standards.

How to Verify a Broker's Regulation

  1. Find the License Number

Every regulated broker must display their license number on their website (usually in the footer).

  2. Visit the Regulator's Website

Go to the official regulator's website and search for the license number or broker name.

  3. Verify the Details

Check that the license is active, the broker's name matches, and there are no restrictions or warnings.

  4. Watch for Clone Firms

Scammers often copy the name and license of legitimate brokers. Always verify the exact legal entity.

Red Flags to Watch For

  • No License Displayed: Legitimate brokers always display their license number.
  • License Cannot Be Verified: If the license doesn't show up on the regulator's website, it's fake.
  • Wrong License Entity: The license holder name should match the broker's legal name.
  • Unregulated Claims: Brokers claiming to be "regulated" but cannot provide a license number.
  • Offshore Only: Regulated by a less strict offshore authority with weak investor protection.
